Terms of Service

1. The service

ainetcafe ("we", "us") provides API access to large language models, including Kimi K3, through OpenAI-compatible and Anthropic-compatible endpoints at https://microquickjs.com. The service is operated by Fedimoss (the Hong Kong company operating ainetcafe; legal name to be inserted on execution of any written agreement). By creating an account or sending a request you agree to these terms.

Model outputs are generated by machine learning models. They can be wrong, incomplete or unsuitable for your purpose. You are responsible for reviewing outputs before relying on them.

2. Accounts

• You must be at least 18 and provide a working email address. One person or company may hold one account unless we agree otherwise in writing.
• API keys are secrets. Anything sent with your key is billed to you, including use by anyone you shared it with. Revoke a key in the console the moment you suspect it has leaked.
• We may suspend accounts created with disposable email addresses, automation, or in numbers that look like an attempt to farm sign-up credit.

3. Credits and billing

• Usage is billed per token at the prices shown on the Model Marketplace at the time of the request. Prices are in US dollars. We may change prices; changes apply to requests made after the change is published.
• Pay-as-you-go balance is prepaid. Requests stop when the balance reaches zero. We do not extend credit and do not issue surprise invoices.
• Prepaid balance, sign-up credit, top-up bonus and promotional credit are non-refundable and cannot be withdrawn, transferred or exchanged for cash. Bonus and promotional credit may expire on the date stated when granted.
• Receipts for card payments are issued by the payment provider at checkout. If you need a tax invoice, contact us before paying; invoices are available for committed plans and, at our discretion, for larger prepayments.
• Chargebacks and payment disputes result in immediate suspension while we investigate.

4. Coding plans

• A coding plan gives a fixed dollar amount of Kimi K3 usage per week and per month, valid for one month from purchase, at the price shown at checkout. Plan quota is consumed before wallet balance; when the quota is used up, requests continue at pay-as-you-go rates from your balance.
• Plans are for interactive use in coding tools by one person. They may not be used for API scripts, batch jobs, resale, shared accounts or multiple accounts. We may revoke keys and cancel the plan without refund if we detect such use.
• Plan fees are non-refundable. Unused weekly or monthly quota does not roll over.

5. Team Starter

• Team Starter is a prepaid trial for companies: a $500 payment provides $1,000 of credit valid for 30 days, one per company domain, with committed-plan service levels during the trial.
• If a committed plan is signed within the 30 days, unused Team Starter credit is applied to the first invoice. Otherwise unused credit expires. The $500 payment is not refundable.

6. Acceptable use

You may not use the service to:

• break the law, or generate content that is illegal where you or your users are;
• attack, probe or overload the service, or circumvent rate limits, quotas or plan rules;
• distil, extract or reproduce model weights, or use outputs to train a competing model, where the model licence prohibits it (Kimi K3 is used under the Kimi K3 License published by Moonshot AI);
• resell access without a written reseller agreement.

You are responsible for content submitted by your own users and for complying with laws that apply to them.

7. Availability

We work to keep the service available and publish a status page. Pay-as-you-go accounts, coding plans and Team Starter carry no uptime commitment and no service credits. Uptime commitments, failover to the official Moonshot API and support response times are offered only under a written committed or core agreement.

8. Your data

How we handle requests, responses and account data is described in the Privacy Policy. Customers who need contractual data-processing terms can execute our Data Processing Addendum.

9. Intellectual property

You own the prompts you send and, as between you and us, the outputs you receive. We own the service, its software, documentation and brand. Model weights belong to their respective licensors.

10. Liability

The service is provided "as is". To the extent permitted by law we exclude implied warranties and are not liable for indirect, consequential or special losses, loss of profit, or loss of data. Our total liability for any claim in a twelve-month period is limited to the amount you paid us in that period. Nothing here limits liability that cannot be limited by law.

11. Termination

You may close your account at any time; remaining prepaid balance is forfeited. We may suspend or terminate accounts that breach these terms, with notice where practical. On termination your API keys stop working immediately.

12. Changes to these terms

We may update these terms. Material changes are announced on the console at least 14 days before they take effect. Continued use after that date is acceptance.

13. Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region. Disputes are subject to the exclusive jurisdiction of the courts of Hong Kong. Contact: [email protected].
